Why the corruption is consistent with growth in Rwanda? There is a steady corruption which undermines Rwandese state legitimacy and economic functioning where a narrow set of few powerful public figures of RPF, the Army and Police, Water and Power companies and private figures from big companies like Breweries (HEINEKEN , Telecoms, Banks ,big construction companies including chineses ones ) control the state. Corruption is also a political battlefield where the opposition effort (not only ethnic but also newly categorized regions of origin (particularly few Tutsi: Ugandans and Genocide survivors but separately) is to ruin or undermine RPF legitimacy by tarnishing its image and reputation by all sort of corrupts activities. This is a nasty state capture. Some highly corrupted potentates do so not only by siphoning funds or letting others do so without reacting but also sabotage RPF reconciliation and fairness efforts: an internal Hutu hidden opposition to RPF working within to destroy a so-called Tutsi leadership. However, the growth finds its path as long as this corruption keeps low level of external transfers and improves the environment business enough to attract the External Financial Development Investments to offset, to certain extent, the external transfers going out. Some corruption channels in good businesses with high added value in some sectors (especially in construction industry) reinforce the growth. The issue becomes inequity and inequality! Growth without development is a zero-sum game through power where few businesses win profits that many others loose in terms of opportunities and funds. This is not specific to Rwanda; Kenya, and other countries are the good examples of the same case. Let’s select some illustrative sectors where Rwanda performs well but at the same time extorts undue resources to its sectors. Policing is probably the most dramatic example here, tax collection targets by the police through (“ funny fines” ( some exaggerated punitive laws ) just designed to maximize the resources collection for direct absorption and regulatory inspectorate ( RURA ( particularly transport )) , to name just two, degenerated into corrupt systems where high-level officials manage and share in the gains of their inferiors and RPF system to maintain the positions . Since the systems combine strong president with proportional representation under which a powerful executive negotiate with a few powerful party leaders to share the spoils of office, that is the case of Rwanda which is an excellent but tricky and promising case study. Given the risk of losing power, they often transfer their savings and profits outside the country for safekeeping, on one hand, on the other hand, the reputation of country for its law enforcement in safety and security brings external investors. The RPF has so far maintained control, in a way the corruption, although stable in high sphere, can’t lead to a breakdown of authority. Some demonstrative cases are advertised and serve as scapegoats. Politics and the profit motive interact to make corruption an entrenched problem in more profitable economic sectors. The corruption is not generalized to every administrative level; rather, it is a kind of strong network at the high level of most institutions building a cobweb liking them altogether defending/protecting/ coopting each other every cult member which make them even stronger than departments representative in office: it works in a way of secret cult. Everyone has a protector/mentor and within the entire network. There 4 main issues at hand:1- corruption through the procurement process : commissions of 10-20% to be paid for the contract . 2- Projects intentionally derailed for new contracts reformulation (addendum) and new commissions; 3- Staffing projects and Agencies: consultants paying bribes to gets contracts and/or staff is not selected on competitive basis. 4-the ineffectiveness of the Monitoring/supervision process: a corrupted supervisor mostly incompetent protects the implementers from any wrongdoing by a good report. The parliament role becomes ceremonial if it can’t even hand over the cases officially audited before Justice. The petty and visible corruption is seriously punished in every sector. The institution Building and some innovations in public resources management have had a multiplicative effect: tax collection system and ICT have, in fact, helped to curb the mismanagement of public funds. As long as, the Party (RPF) is still in control and is trying to manage an economic transformation, the economic performance will be strong, though, not optimal. To name few these are important infrastructure projects which have left the country seriously indebted: Karisimbi Project, Kigali Convention, the Nyamata New Airport in course of construction and the subsequent highway to Kigali Town, Kivu Gas Plateform,… To illustrate this : The case of infrastructure is striking :Chinese Construction Companies do feasibility studies, finance, and execute because the projects are either : various conflicting roles of feasibility and lending the projects on one hand, and executing and funding the projects. While the Government makes visible efforts to minimize the corruption channels, these efforts are sometime spoiled by political interference not necessarily emanating from the Top executives. Some appointed incompetent executives can’t simply rely on its staff: they must build parallel channels including external experts (East Africans especially) to siphon funds and have last advice to hide incompetence and embezzlement. The common reason found which made easy the corruption is then to politicize the projects management by HANDING OVER special projects to a SPECIAL unit out of the Administrative Bureaucracy reporting to a newly designated Authority or directly to the Ministry/State Ministry/Permanent Secretary ( almost secretly since there is no dispatch through hierarchy ). The negotiation of getting a specific unit is often shown as wise and good intention of speeding up the project implementation. This might be good to ensure the outcome only if strict adherence and compliance to agreements are guaranteed without any change whatsoever! Experience show secret or limited capacity negotiations in our projects have shortcomings which end up in Agreements Review. It is plausibly highly risky to take the projects out of the Agencies routine because various personal interests will overtake those of the Bureaucratic Agency ( the collective interest) . Executive Managers cannot perfectly monitor official behavior, so lower-level Officers often collect bribes that permit contracts to be given to poorly qualified firms and that allow asset sales to bidders who do not provide the state with the highest return. If the programme (various projects) operations reporting process must be very transparent and accessible to the whole bureaucracy concerned, if not, the reporting process is meant to hide wrongdoings or malpractices. The other reason is to always USE CONSULTANTS (Kenyans, UK, US,…) for the whole projects management cycle process leaving any memory and institutional accountability and capacity development, leaving the ministry staff unaware and incompetent. As a response to this issue, there are almost a Central Executing Agency for each Ministry. This Agency or Authority should be in charge off all National level projects under the same Ministry regardless of consultancy services needed or not. Districts are to be associated in monitoring and evaluation if their own interests are vested. If the national capacity development is key to overcome some corruption issues the Recurrent Consulting (especially international although necessary) is destructing (demotivating and unemployment effects on national staff) and exacerbates corruption when not well supervised which is the case. Outsourcing services in quite normal to certain extent. Differences between countries stem from differences in national human capacities. They can mostly use local outsourcing. There is no way a country can develop based on consulting services supplementing a chronic human resources shortage. Recruiting biased on criterion like families alliances ties, gender exploitation, is even worse than using consulting/outsourcing. They are just needed to fit into public human resources as a temporary support but not regularly renewable. Rather the Government has to deal with the weaknesses of Agencies and fix them and operate inside. This will help much in curbing the corruption while developing strong institutions, a precondition to combat the corruption. The other big problem of renting private properties for public use which go for years and years just for rent seeking without prioritizing public construction with a view to perpetuate gains . Example among others; the Power and Water companies which generate funds don’t lodge most theirs substations in their own buildings in most places .They should plan ahead many construct offices /stations in various areas like police, schools, or health centers or local administration. Land Administration which loose opportunity of generating billions by corruption in construction permits: the duration can’t be sped up without bribes in complicity with REMA officers, a complex network is in place. Of course, some progress has been made but still many days to cut down are not achieved lost to sleeping officers waiting to be reminded in private: Face to Face, no Official Telephone,…!!! Addressing corruption will be much more effective when addressing the issues of the public service productivity. The changes which improve the integrity and efficiency of the public sector staff can seriously reduce the corruption :the discretionary power to be progressively and sharply replaced by the transparent global internal control framework fed through various automated Ministries/Agencies working stations to ensure : - The Information is systematically recorded, transferable, traceable, protected, archived and secured. This can be, somehow, deterrent to many malpractices feeding corruption . Direct attacks on corruption through the criminal law are not sufficient since the Justice is also to closely monitor. Strong institutions must lodge in strong buildings for the sake of institutional memory, among other sustaining reasons! RPF Funding crowding effect While all funding should be welcomed, there are RPF investments although free to invest in any sector, they crowd other private funding out when it goes through or alongside with individuals capital in maturity or saturated stage of economic subsectors because of the RPF low cost of capital. It is unfair for the competition. Other investors using normal bank loans at around 18-19% rate can’t compete with RPF investment with its bargaining power. This RPF capital works like using bad money to chase a good one hardly earned. RPF would not only reap much more profit but also avoid fuelling fear in business environment and banks accounts spy if it invests in new or underfunded economic subsectors. There are many like vertical construction for low income, long-term housing finance and Insurance schemes, improve the international transport coupled with sea dry ports with authorized customs services as a new development poles, participating more in the capital market and/or Rwanda Stock Exchange. Targeting step by step Chinese construction market portion and/or eventually using various ventures to compete with Chinese and other international companies in construction subsector (roads, and buildings). Individual banks accounts are sacred: SOME SPIES PRETENDING TO BE ON BEHALF OF RPF DON’T ONLY MONITOR BANKS ACCOUNTS BUT ALSO THREAT BOTH BANKS MANAGERS AND ACCOUNTS HOLDERS IF THEY NOT SERVE THE REQUIRED AMOUNT TO RPF. RPF CHAIRMAN MUST TAKE A CLEAR STANCE ON THIS MATTER, to reassure the Diaspora and national investors before it gets worse by making it stop and paying back to those victims of these malpractices. Banks, in any way, should not be put under any other rules apart from National Bank supervision. People do no longer feel confident in banks from a certain amount. This has had an alarming impact on liquidity within the banks: check the trend of SAFE sales and remittances through banks. Since then our banks deposits are being diverted/kept mainly in neighboring or Southern African countries. NPD COTRACO, RESERVE FORCES, HORIZON, CAR PARKING Veterans Cooperative Authorized malpractices: These corporations have monopoles in the public sector construction and car parking in public space which accounts for billions which undermine the capacity development in the construction sector. Although preferences must be given to national companies, these corporations should face some competition in order to stimulate the sector construction competences. The car parking business is not only for fee levy but also to promote the transport sector (vertical parking and green transportation (fuel, transport companies ( buses, taxis,… )). The sole acceptable public monopole should be the use of the force by the Police and RDF. These practice fuels corruption between ministries concerned and these Corporations while contracting .The opacity can’t be avoid in these monopoles with strong political power.
